Terms of Sales

These general terms and conditions of sale are established between Artpixe and any individual wishing to make a purchase via the website.www.artpixe.com".

These terms apply to consumers and govern all sales concluded from the online store named Artpixe.

The Customer is clearly informed and acknowledges that the Site is intended for consumers and that professionals must contact the Company's sales department to benefit from separate contractual conditions.   1. Object

These general terms and conditions of sale aim to define the contractual provisions between the Company and the Client as well as the conditions applicable to any purchase made via the Site. The acquisition of a product on the Site implies the Client's unconditional acceptance of these general terms and conditions of sale.

The Company reserves the right to modify these general terms and conditions of sale at any time and without prior notice. Thus, the applicable conditions will be those in effect on the date of the order by the Customer.

  1. Features of the products offered for sale

The Company undertakes to provide the essential characteristics of the products offered for sale.

The Client agrees to read these information carefully before placing an order on the Site.

The products for sale are described and presented with the greatest possible accuracy. In case of error or omission in this presentation, the Company's liability cannot be engaged. The photographs and texts illustrating the products are indicative and non-contractual. The Company reserves the right to modify its catalog without notice.

Products are offered for sale within the limits of available stock. The unavailability of a product is generally indicated on the page of the concerned product. In case of an error regarding the availability of an ordered product, Artpixe will inform the Customer by email as soon as possible. Artpixe will then offer the Customer:

  • To ship all the products of the order at the same time as soon as the out-of-stock products are available again.
  • Either ship the out-of-stock product alone as soon as it becomes available.
  • Either cancel the order for unavailable products. The Client will receive a full refund of the amounts paid for the unavailable products no later than thirty (30) days from the payment.

The products for sale on the Site are only available for delivery to the following territories: Metropolitan France, Belgium, Germany, Ireland, Portugal, Italy.

  1. Prices

The prices displayed in the Site's catalog are inclusive of all taxes (TTC) in euros (€), taking into account the value-added tax (VAT) applicable on the day of the order. Any change in the rate may be reflected in the price of the items. The Company reserves the right to modify its prices at any time, it being understood that the price displayed on the day of the order is the only one applicable to the Customer. The indicated prices include order processing fees.

The prices of the products are understood to be excluding delivery charges.

The amount of shipping fees is specified on the Site before order confirmation.

  1. Orders

To purchase a product on the site, the Client must be at least eighteen (18) years old and have legal capacity or, if they are a minor, be able to provide proof of consent from their legal representatives.

The Client must provide information allowing for their identification by completing the form available on Artpixe. The asterisk (*) indicates the mandatory fields that must be filled out for the Client's order to be processed by the Company.

The information provided by the Customer when placing an order must be complete, accurate and up to date. In the event of an error in the wording of the contact details, the Company cannot be held responsible for the impossibility of delivering the package. The Company reserves the right to ask the Customer to confirm, by any appropriate means, their identity and the information communicated.

4.1 Ordering Process

Product orders are placed directly on Artpixe.

To place an order, the Client must follow the steps described below:

  • Choice of options, image import and add to cart;

  • Cart validation;

  • Delivery details information;

  • Delivery method selection;

  • Choice of payment method;

  • Acknowledgment and acceptance of these general conditions of sale by checking the corresponding box;

  • Payment validation.

4.2 Selection of items and addition to basket

The Customer will be able to choose the desired items by clicking on those that interest them, and specifying the desired characteristics and quantities. After selection, the item is added to the Customer's basket. The latter can continue to add other items to their basket according to their needs.

4.3 Cart Confirmation

After selecting the items and adding them to the cart, the Customer will need to click on the cart to verify that the order is correct.

Once the cart is validated by clicking on "PROCEED TO CHECKOUT" or "Pay with PAYPAL", an order summary will be displayed with the price details, applicable taxes, and, if applicable, shipping fees.

4.4 Entering Delivery Information

The Client will be invited to provide the necessary information for identification and shipping.

He can then choose the delivery method offered and provide the information related to his payment method.

4.5 Payment and acceptance of the general terms and conditions of sale

The Client must verify the contents of their order (quantity, characteristics of the items, billing address, payment method, and price) before validating it.

He can then proceed to pay for the items by confirming the order.

For some special requests, such as adding large items, additional charges may apply. If this is the case, the Customer will be informed by email of the additional amount to be paid.

4.6 Confirmation and receipt of the order

Once all the steps are completed, a confirmation page will be displayed on the Site to acknowledge receipt of the order. A copy of the confirmation will be sent by email to the Client, provided that the email address provided is correct.

Artpixe.com does not send order confirmations by mail or by fax.

4.7 Billing

During the ordering process, the Customer must enter the necessary information for billing (the fields marked with an (*) are mandatory for the order to be processed by Artpixe.com).

Neither the online order form nor the acknowledgment of receipt sent by email constitutes an invoice. Upon request, Artpixe.com will send the invoice related to the order by email, provided that the email address provided is correct.

  1. Payment Methods

The Client will be able to pay for their items online on the Site via:

  • Bank card
  • Paypal

The Client assures Artpixe.com that they hold all the necessary authorizations to use the chosen payment method.

Artpixe.com will take all necessary measures to ensure the security and confidentiality of data transmitted online during payment on the Site.

In the case of payment by credit card, the Client's account will be debited as soon as the order is validated on the Site.

If for any reason, opposition, refusal or otherwise, the transmission of the payment due by the Client proves impossible, the order will be canceled and the sale automatically terminated.

  1. Shipping and Delivery Times

Delivery of digital portraits takes place by transmission to the customer's email address, provided when ordering.

For physical portraits, delivery is made to the address provided in the delivery information supplied by the Client. It is imperative that the Client ensures the accuracy and completeness of the information transmitted to Artpixe.com via the site, as the company cannot be held responsible for losses or delays due to errors or complications related to the carrier.

Shipping costs are determined according to the chosen delivery option. They will be the responsibility of the Customer, in addition to the price of the products.

The mentioned deadlines are indicative, and we inform you that potential delays may occur on the part of the carrier, beyond our control.

The Customer has thirty (30) working days from the date of dispatch to notify by email to the address: hello@artpixe.com a non-receipt of the order. Beyond this deadline, no cancellation of sale will be accepted. Any anomaly observed (missing item, damaged package, broken item, etc…) must be reported within three days of receipt. It is the Client's responsibility to check the condition of the items upon delivery. In case of defective products, the Client is requested to provide images (photographs) as proof of the observed defects.

"After confirmation by Artpixe of a defect, we will either proceed with a refund (partial or total depending on the severity of the defect) or with the replacement of the item."

If the delivery is confirmed by the carrier's parcel tracking but the Client has not received their parcel, they must file a complaint with the carrier. Artpixe cannot be held responsible and no compensation or reshipment will be possible.

For orders outside metropolitan France and Belgium, customs fees or other local taxes (local VAT, customs duties, import rights, etc...) may apply. These fees are the sole responsibility of the customer and fall under their responsibility, both for declarations and payments to the competent authorities.

  1. Warranties and Liability

7.1 Guarantee of Conformity

"According to articles L.217-4 and L.217-5 of the Consumer Code, Artpixe is required to provide products that conform to the contract, free from defects in conformity at the time of delivery."

The conformity of the product implies that it is suitable for the usual use of a similar good and that it corresponds to the description given on the site. In case of a lack of conformity, the Client may request an exchange of the product. If an exchange is not possible, Artpixe commits to refunding the price of the product within thirty (30) days following the receipt of the non-conforming product.

7.2 Warranty Against Hidden Defects

Artpixe offers a warranty against hidden defects that render the product unfit for its intended use, in accordance with Article 1641 of the Civil Code. The Customer can obtain a refund by proving the existence of a hidden defect and returning the product.

7.3 Liability

Artpixe's liability cannot be engaged in the event of a breach or poor execution of the Client's contractual obligations, particularly during the entry of their order. Our liability also does not cover damages resulting from the use of the Internet network such as data loss, intrusion, viruses, service interruption, etc.

  1. Complaints

Complaints must be sent in writing to the email address: hello@artpixe.com.

  1. Modification of the General Terms and Conditions of Sale

Artpixe reserves the right to modify these general terms and conditions of sale at any time. The GTC in effect at the time of the order will be applied.

  1. Miscellaneous Provisions

If any provision of these General Terms and Conditions is deemed null and void, it shall be considered unwritten without affecting the validity of the other provisions.

"Any tolerance or waiver by one of the parties in the application of the commitments shall not constitute a modification of the General Terms and Conditions, nor generate any right whatsoever."

  1. Personal Data

Artpixe collects personal data on the site, notably through cookies for anonymous visit statistics.

Clients can disable cookies through their browser settings.

The information collected is necessary for the management of orders and business relationships. It may be shared with partners contributing to the execution of services and orders.

In accordance with law n°78-17 of January 6, 1978 relating to data processing, files, and freedoms, as amended by law 2016-41 of January 26, 2016, the Client has the right to access, rectify, object (for legitimate reasons), and delete their personal data. 12. Applicable law, competent jurisdiction, and mediation

These general conditions of sale as well as the relations between the Customer and the Company are governed by French law.

For all disputes arising from these general terms and conditions of sale, including those relating to their validity, interpretation, execution, or resolution, only French courts shall have jurisdiction.

13. Withdrawal

The production of graphic works entrusted by the client to Artpixe is analyzed as the provision of goods made according to the specifications of the consumer or clearly personalized, the Client cannot claim to exercise a right of withdrawal in accordance with the provisions of Article L. 221-28, 3° of the Consumer Code.

Consequently, any right of withdrawal in favor of the Client is therefore excluded in this case, unless the parties have agreed otherwise.
